Returns and refunds
Legal information for the catalog, accounts, forms, alerts and technologies used by the website.
5.1 Current situation
The website does not allow online purchases to be concluded or paid for. There are therefore no returns of orders concluded through the current checkout. This policy sets out the basis that must be completed and displayed before sales are enabled.
5.2 Future right of withdrawal
As a general rule for distance contracts with consumers, information will be provided before purchase about the statutory withdrawal period, how to exercise it, return costs and the relevant model form. The operating reference is a period of 14 calendar days where the right applies.
Not every living plant will be treated as automatically excluded merely because it is perishable. The possible application of an exception must be validated by counsel, justified for the specific product and clearly disclosed before the contract is concluded. This policy does not remove rights relating to lack of conformity or damage during transport.
5.3 Online withdrawal function
Before distance contracts are enabled through an online interface, a function bearing an unambiguous withdrawal indication must be implemented and remain prominently and continuously accessible during the applicable period. The function must allow the person and contract to be identified, the withdrawal statement to be submitted, and immediate confirmation to be provided on a durable medium. Counsel must confirm the Spanish application of this obligation in force since June 2026.
5.4 Difference between withdrawal, damage and lack of conformity
- Withdrawal: a decision to terminate the contract within the applicable period without needing to allege a defect.
- Transport damage: deterioration, breakage or loss connected with transit or packaging.
- Lack of conformity: an incorrect specimen, a condition not described, the absence of an agreed characteristic or another legal failure.
- Subsequent care issue: a situation that may depend on light, watering, temperature, substrate or acclimatization and must be assessed without automatically presuming responsibility on either side.
5.5 Reporting incidents
To resolve a transport incident promptly, the customer will be asked to make contact as soon as reasonably possible and provide photographs of the outer box, label, internal packaging, complete plant and damage detail, together with the order number. A recommendation of 24 to 48 hours assists the investigation but does not by itself extinguish statutory rights if notice is given later.
5.6 Future returns and refunds
Where a return is appropriate, SUCCULON will provide instructions compatible with the living nature of the specimen. Return costs will be allocated according to the pre-contractual information and the reason for return: costs resulting from lack of conformity or an error attributable to SUCCULON will not be passed to the consumer.
Refunds will be made by the legally appropriate means and within the applicable time limit. Before commercial launch, the payment provider, refund rules, disputes and settlement account must be documented.
