Terms and conditions

4.1 Scope

These terms govern use of the SUCCULON catalog, accounts, forms and alerts. They do not yet govern an operational checkout. Creating an account, submitting an enquiry or selecting a specimen does not by itself constitute a sales contract.

4.2 Current commercial status

CATALOG MODE: The cart, checkout and payment gateways are blocked. No amount displayed can be charged through the website and it must not be interpreted as a final contractual price until a compliant purchase process is enabled and all pre-contractual information is provided.

4.3 Accounts

Users must provide accurate data, protect their credentials and report unauthorized access. Newsletter and alert preferences are optional. SUCCULON may block an account because of fraud, abuse, security risk or breach, while respecting existing obligations and rights.

4.4 Catalog, exact specimen and photographs

Where a listing is presented as an individual specimen, the operating intention is that the photographs correspond to that specific plant. Plants are living organisms and may show natural changes in hydration, color, flowering, roots or minor marks between the photograph and a future delivery. No image editing may misleadingly alter the condition, shape, damage or flowering of the specimen.

4.5 Availability, reservation and prices

The appearance of a plant in the catalog does not guarantee availability, reservation or a right to purchase. In catalog mode, amounts are indicative information and may change before any future offer. Before sales are enabled, the website must clearly show the total price, taxes, delivery costs, restrictions and payment methods.

4.6 Botanical and care information

Taxonomic identification and care guides are prepared with due care, but uncertainties or classification changes may exist. A listing must indicate material uncertainty. General information does not replace a professional assessment of plant health, toxicity, CITES or destination requirements.

4.7 Phytosanitary and territorial compliance

SUCCULON will not confirm a future sale or shipment where a mandatory authorization, passport, certificate, evidence of origin or territorial condition is missing. Until official proof exists, the website will not claim that SUCCULON is authorized to issue plant passports.

4.8 Communications

Responses to enquiries and availability alerts are informational unless they expressly state a complete offer with full terms. Marketing communications require consent or another valid legal basis and will include a simple, free means of unsubscribing.

4.9 Guarantees and mandatory rights

When sales are enabled, no reference to the living nature of a plant, transport, packaging or communication periods will reduce statutory rights relating to lack of conformity, incorrect delivery or damage attributable to the seller or to a carrier engaged by the seller.

4.10 Amendments and precedence

The applicable version must be the version presented and accepted before a transaction. Later changes will not retroactively alter relationships already formed. If any clause is invalid, the remaining clauses will continue to apply to the extent permitted.

4.11 Complaints and applicable law

Complaints may be sent to succulon@gmail.com. Spanish law applies without depriving consumers of mandatory protection in their place of residence. Before sales are enabled, counsel will confirm alternative dispute resolution obligations and the applicable regional or sector-specific channel.
